MAP Policy
Dear Valued Dealer,
With the purpose of maintaining the integrity of all the Metal FX Motorsports Inc. brands in the North American marketplace, we have implemented a MAP (Minimum Advertised Price) Policy for dealers of Metal FX Motorsports Inc. products.
The objective of this MAP Policy is to protect and support the significant resources our authorized dealers dedicate to promoting our brands, as well as our brands’ consumers. Metal FX Motorsports Inc. wants to ensure that consumers are properly informed of the value of our products by highlighting their quality, features, and benefits.
This policy does not intend to interfere with our dealers’ business practices but has been implemented to encourage our dealers to dedicate the required time and effort to our products, so they can stay competitive in the market.
Effective on June 1st, 2022, it will be a requirement that all Metal FX Motorsports Inc. dealers advertise Metal FX Motorsports Inc. products NO LOWER than the current published US MAP Policy Price (Retail). Prices below MAP Policy may not be advertised on print, internet, radio, television, or any other medium. “Advertising” includes any communication that identifies any Metal FX Motorsports Inc. products with consumers or potential consumers. “Advertising” does not include in-store communication between retailers and consumers, live telephonic communication or emails and private, non-automated communications initiated by consumers or one-on-one responses to those emails.
Dealers who resell to other retailers will be held responsible by Metal FX Motorsports Inc. for the MAP Policy compliance of their customers and any retail entities that they supply.
Metal FX Motorsports Inc. reserves the right to modify its US MAP Policy Price Schedule and to modify, add or remove any products at any time at our sole discretion.
The MAP Policy is not intended to dictate the selling price of Metal FX Motorsports Inc. products between dealers and their customers. The prices for which dealers sell Metal FX Motorsports Inc. products are established solely between the dealers and their customers. The MAP Policy applies only to advertised prices as specified in this document.
Metal FX Motorsports Inc. will administer and enforce this MAP Policy at its own and sole discretion. Violators of this MAP Policy will be subject to enforcement actions including –but not limited to– a reduction in purchase discounts (i.e., a percentage of reduction for certain number of days), loss of eligibility for any discount, loss of eligibility to purchase Metal FX Motorsports Inc. products for a specified period of time or indefinitely, and termination, as determined by and at the sole discretion of Metal FX Motorsports Inc.
The first violation of the MAP Policy that a dealer commits, will be notified to the dealer by a message from Metal FX Motorsports Inc. requesting the dealer to adjust their prices in compliance with the policy. If the violation occurred on the internet, radio or television, the dealer must take corrective action within five (5) business days after being notified. If the violation occurred in print or catalog, the dealer must take corrective action by redacting the previous price point for the next print cycle.
Metal FX Motorsports Inc. reserves the right to take stronger enforcement actions against dealers who violate this MAP Policy, as considered appropriate by Metal FX Motorsports Inc.
This MAP policy will be effective until further notice. Changes will be made in writing by Metal FX Motorsports Inc. If any portion of this policy is found to be in violation of any applicable local, state, or federal law, the remaining provisions will remain in effect.
